some information on presidential powers and military action:
“The War Powers Resolution of 1973 gives a president 60 days to obtain congressional approval after making foreign military strikes and informing Congress “within 48 hours.” Otherwise, he then has another 30 days to cease the operations.

The Authorization for Use of Military Force (AUMF), passed a week after the 9/11 terrorist attacks in 2001, allowed the president to “use all necessary and appropriate force” against those involved in the attacks. Since then, presidents have used the Bush-era law to justify military action in the Middle East.”  (SOURCE)

The way I see this – at this point – is that Iranian forces attacked the U.S. Embassy in Iran.  U.S. forces then fought back.  Iran made the declaration of war (as they have been threatening to do for months).  I don’t see this as the US declaring war.  I see this as US Forces protecting its “property”.  As this man puts it:
